MyChart Terms of Use

MyChart Medical Record Access is an internet application that enables a patient to have secure web-based access to portions of their Mary Washington Healthcare (MWHC) electronic medical record, and allows a secure, convenient communications channel with MWHC and its providers for non-urgent messages. Use of MyChart is entirely voluntary and you are not required to use MyChart to receive care from MWHC. However, by using MyChart you indicate your acceptance of these Terms of Use. If you do not agree to these Terms of Use, do not access or use MyChart.



Use of MyChart
MyChart is provided to MWHC patients to assist those patients in managing their health records, securely communicating with their health care providers through electronic means, and accessing other healthcare related information. MyChart provides you with access to only portions of your medical record maintained by MWHC, not your complete medical record. You agree that you will only use MyChart for legitimate and lawful reasons associated with your health and health care.

MyChart Does Not Provide Medical Advice
MyChart is provided for your convenience to help manage your health care and health information. MyChart is not a health care provider; therefore, use of MyChart does not create a health care provider/patient relationship between you and MWHC. Use of MyChart is not a substitute for professional medical advice, diagnosis, or treatment. You should always seek the advice of a physician or other qualified health care provider with any questions regarding your health or medical conditions.

If you suspect that you have a medical problem or condition, please contact a qualified health care professional immediately. Never disregard, avoid, or delay in obtaining medical advice from your doctor or other qualified health care provider because of your use of MyChart. Privacy and Security of Personal Information
MyChart is designed to be compliant with the privacy and security requirements of the Health Insurance Portability and Accountability Act of 1996 and is protected using industry standard security measures. While the security measures should reasonably protect your information, if you have any concerns regarding the security of your information or the use of the Internet to access your medical record or transmit information through MyChart, you should not use MyChart.

You, not MWHC, are entirely responsible for your use of MyChart and all information that you transmit through MyChart. MWHC does not control your submissions, and, as such, does not guarantee the accuracy, integrity, or quality of such information. You represent and warrant that all information provided by you to MWHC or through MyChart is accurate and reliable.

Links
MyChart may provide links to other websites or resources. You acknowledge and agree that MWHC is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, services, or other materials on or available from such sites or resources. If you access third party sites linked to MyChart, you do so entirely at your own risk.

Username and Password
You will create a username and password upon completing the registration process for a MyChart account. You are fully responsible for all activities that occur under your account. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your account. It is your sole responsibility to (i) maintain the confidentiality of your user name and password, and (ii) promptly inform MWHC of any need to deactivate or reset your account. You agree to immediately notify MWHC of any unauthorized use of your password or account or any other breach of security and to ensure that you exit from your account at the end of each session. MWHC is not responsible for breaches of confidentiality caused by you or an independent third party.

Accuracy and Integrity of Information
It is possible that MyChart could include typographical errors or other inaccuracies. If you identify an inaccuracy in your MyChart record, please contact the MWHC Privacy Officer at 540.741.1821.

Use by Children
MWHC is committed to protecting the privacy of children. You must be 18 years of age or older to use MyChart. You represent and warrant that you are at least 18 and that you possess the legal right and ability to enter into this Terms of Use agreement and comply and abide by the obligations hereunder.

Termination
MWHC, at its sole discretion, may suspend or terminate your account and/or deny you access to, or use of, all or part of MyChart without prior notice if you engage in any conduct that MWHC believes violates any term or provision of these Terms of Use, or is otherwise deemed inappropriate by MWHC.

Amendment
MWHC may modify and amend these Terms of Use at any time. Any modifications made will be effective immediately upon posting on MyChart. Your continued maintenance of an account to access and use of MyChart will be deemed your acceptance of the modified Terms of Use.

Indemnification and Limitation of Liability
You agree that you are solely responsible for your use of MyChart and you will defend, indemnify, and hold MWHC, its officers, directors, affiliates, employees, agents, licensors and suppliers, harmless from and against any claims, actions, demands, losses, expenses, liabilities, damages and costs arising out of or related to your use of MyChart or any violation of these Terms of Use by you. This obligation will survive the termination of your MyChart account or MyChart itself. You expressly understand and agree that MWHC shall not be liable to you for any damages that arise from your use or inability to use MyChart.
